Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("you", "your", the "user") and HomeDea LLC, a limited liability company registered in the State of Wyoming, United States of America ("the Operator", "we", "us", "our"). They govern your access to and use of Lingomir, the language-learning application and website available at https://lingomir.com (the "Service").

By creating an account, using the Service as a guest, or subscribing, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.


1. The Service

Lingomir is an online service that helps Russian speakers learn the Serbian language. It provides structured lessons, spaced-repetition review, vocabulary practice, gamified progress tracking (experience points, levels, streaks, quests), and interactive practice conversations with in-app artificial-intelligence ("AI") characters, together with AI-assisted grading, translation, and text-to-speech audio.

The Service is delivered as a web application today. Native mobile applications may be offered in the future; when they are, these Terms will apply to them as well.

We may add, change, or remove features, lessons, and content at any time to improve the Service or to meet legal or technical requirements. We will not materially reduce the core paid features you are entitled to during a paid period without notice as described in Section 6.


2. Eligibility and age requirement

You must be at least 16 years old to use the Service. By using the Service you represent that you are 16 or older. The Service is not directed to children under 16, and we do not knowingly collect personal data from them. If we learn that we have collected personal data from a person under 16, we will delete it. See the Privacy Policy for details.

If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.


3. Accounts

3.1 Guest accounts

You may start using the Service as a guest without providing an email address. A guest account is stored on our servers under an anonymous identifier so that your progress is saved. Guest accounts are temporary: they may be removed after an extended period of inactivity, and progress tied only to a guest account can be lost if you clear your device, switch devices, or lose the session. To protect your progress, you should convert your guest account into a registered account.

3.2 Registered accounts

To create a registered account you provide an email address and a password, and you may optionally provide a display name. When you register, your existing guest progress is promoted to your new account. During registration you must accept these Terms and the Privacy Policy; you may separately and optionally opt in to marketing email (see Section 3.4).

You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us at support@homedea.com without delay if you suspect unauthorized use. Passwords are stored only in hashed form (bcrypt) and cannot be recovered by us — you can reset your password using the account-recovery flow.

3.3 Accurate information

You agree to provide accurate information and to keep it up to date. One person may not maintain multiple accounts to circumvent free-tier limits, trials, or promotions.

3.4 Communications

By holding an account you agree to receive transactional and service messages (for example: account, security, billing, subscription, and important product notices). These are necessary to operate the Service and are sent regardless of marketing preferences. Marketing email (tips, offers, product news) is sent only if you have separately opted in; you can withdraw that consent at any time in your profile settings or via the unsubscribe link in any marketing message. See the Privacy Policy for how we handle your data.


4. Free tier and fair use

The Service offers a free tier that lets you use core functionality at no cost, subject to daily and periodic limits. As of the date of these Terms the free tier includes, by way of example: three new lessons per calendar week with at least one lesson-free day between lessons, a limited allowance of AI practice-dialogue messages, and a periodic (for example, weekly) sample of the premium Immersion experience. The exact limits are shown in the app and may change over time.

The free tier is provided for personal, non-commercial learning. You agree not to use automated means, scripts, or multiple or shared accounts to exceed the intended limits or to place an unreasonable load on the Service. We may apply reasonable technical limits and anti-abuse measures to protect the Service and other users.


5. Premium subscription

5.1 What Premium includes

Premium is a paid subscription that unlocks the full Service, including (as offered from time to time) unlimited new lessons, an expanded AI practice-dialogue allowance, the full Immersion experience, and other premium features described in the app. The current feature list and limits are shown at the point of purchase.

5.2 Plans and pricing

Premium is offered as a monthly plan and an annual plan:

All prices are shown inclusive of any applicable taxes where required. The price, currency, and billing interval that apply to you are displayed and confirmed before you complete your purchase. Prices may differ by region and may change as described in Section 6.

5.3 Free trial

We may offer a 7-day free trial of Premium to eligible new subscribers. Trial eligibility and terms are shown at sign-up; a trial may be limited to one per user. Unless you cancel before the trial ends, the trial automatically converts into a paid subscription and your chosen plan's price is charged to your payment method at the end of the trial. You can cancel at any time during the trial to avoid being charged — see Section 5.5 and the Refund & Cancellation Policy.

5.4 Automatic renewal

Premium is a recurring subscription. Unless you cancel, it renews automatically at the end of each billing period (each month for the monthly plan, each year for the annual plan), and your payment method is charged the then-current price for the next period. By subscribing you authorize us and our payment processor Stripe to charge these recurring payments until you cancel.

5.5 Cancellation

You can cancel your subscription at any time from your account/subscription settings in the app (or by contacting support@homedea.com). Cancellation stops future renewals; it takes effect at the end of the current paid period. You keep Premium access until that period ends, after which your account reverts to the free tier. Cancelling does not by itself entitle you to a refund of the current period, except where required by law or by our Refund & Cancellation Policy.

5.6 Payment

Payments are processed by our third-party payment processor Stripe. We do not store your full card number; card data is handled by the processor under its own terms and security standards. If a payment fails, we may retry it and may suspend or downgrade Premium access until payment succeeds.


6. Price changes

We may change subscription prices and the composition of plans. If a change affects a subscription you already hold, we will give you at least 30 days' notice by email and/or in-app before the change takes effect on your next renewal. The new price applies from your next renewal after the notice period. If you do not agree to the new price, you may cancel before it takes effect; continuing your subscription after the effective date constitutes acceptance of the new price. We will never change the price of a billing period you have already paid for.

We may offer one-time top-up packs that add a fixed quantity of AI practice-dialogue messages (or similar consumable allowances) to your account. Top-up packs:


8. AI-generated content — important disclaimer

The Service uses AI to generate practice conversations, examples, corrections, translations, and audio. AI output can be inaccurate, incomplete, or inappropriate for a given context. The Service is an educational aid and language-practice tool only. It does not provide professional, legal, medical, financial, immigration, or other expert advice, and AI characters are fictional software, not real people or qualified professionals.

You should not rely on AI-generated content as a sole source of truth. Verify anything important with an appropriate authoritative source or a qualified professional. Lesson and reference content is prepared with care but may still contain errors; we welcome corrections at support@homedea.com.

Your practice-conversation messages and certain inputs are sent to third-party AI providers for processing, as explained in the Privacy Policy. Do not enter sensitive personal information, credentials, or confidential data into AI conversations.

10. Intellectual property

10.1 Our content

The Service and all of its content — including lessons, curricula, text, illustrations, audio, characters, software, designs, and trademarks — are owned by the Operator or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service and its content for your own language learning, subject to these Terms. No other rights are granted; you may not copy, distribute, publicly perform, or create derivative works from our content except as allowed by these Terms or mandatory law.

10.2 Your content

You retain ownership of the content you submit, including your practice-conversation messages and other inputs ("User Content"). You grant the Operator a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, and process your User Content solely to operate, secure, personalize, and improve the Service and to provide the features you request (including sending your inputs to the AI and other processors described in the Privacy Policy). This licence ends when your User Content is deleted, except for content already shared with processors, retained backups pending deletion, and records we must keep by law. You are responsible for your User Content and confirm you have the right to submit it.


11. Third-party services

The Service relies on third parties (for example hosting, AI providers, the payment processor, and email delivery). Your use of the Service may be subject to those providers' terms where relevant. We are not responsible for third-party services we do not control, but we choose our processors with care and bind them by contract as described in the Privacy Policy.


12. Suspension and termination

You may stop using the Service and delete your account at any time (see Delete Account). Deleting your account does not automatically refund any prepaid amount except as required by law or our Refund & Cancellation Policy.

We may suspend or terminate your access, in whole or in part, if you materially breach these Terms, if we are required to by law, or to protect the Service or other users. Where reasonable and lawful we will give notice and an opportunity to cure. On termination, your right to use the Service ends; sections that by their nature should survive (including Sections 8, 10, 13, 14, and 15) survive termination.


13. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content (including AI output) is accurate or will meet your learning goals.

Nothing in these Terms excludes or limits any warranty, guarantee, or right that cannot be excluded or limited under mandatory law, including consumer-protection law (see Section 16).


14. Limitation of liability

To the maximum extent permitted by law:

These limits do not apply to liability that cannot be limited under mandatory law — including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or under mandatory consumer-protection law. Nothing in these Terms affects your non-waivable statutory rights.


15. Indemnity

To the extent permitted by law, and except where caused by our own breach or negligence, you agree to hold the Operator harmless from third-party claims arising out of your unlawful use of the Service or your breach of these Terms. This does not apply to consumers to the extent mandatory law provides otherwise.


16. Governing law, consumers, and disputes

These Terms and any dispute relating to them are governed by the laws of the State of Wyoming, United States of America, without regard to conflict-of-law rules.

If you are a consumer: this choice of law does not deprive you of the protection of the mandatory provisions of the consumer-protection law of your country of habitual residence. If you are resident in the European Union or the European Economic Area, you keep the mandatory consumer rights of your home country, and you may bring proceedings in the courts of your place of residence where mandatory law so provides.

EU Online Dispute Resolution: consumers in the EU may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr to submit a dispute. Our contact email for this purpose is support@homedea.com. We are, however, happy to try to resolve any issue directly first — please contact us.

Subject to the mandatory consumer rights above, the state and federal courts located in the State of Wyoming, USA have jurisdiction over disputes relating to these Terms.


17. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email and/or in-app in advance and update the "Last updated" date above. For changes that affect an active paid subscription, Section 6 (price changes) and applicable law apply. Your continued use of the Service after the changes take effect constitutes acceptance. If you do not agree, you should stop using the Service and may cancel and/or delete your account.
